These terms cover the free EzyInsp iOS app. EzyInsp Pro has its own terms at pro.ezyinsp.com/terms.

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and EzyInsp ("we," "us," or "our") regarding your use of the EzyInsp mobile application (the "App") and related services.

By downloading, installing, or using EzyInsp, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

2. Description of Service

EzyInsp is a mobile application designed for property inspection professionals, real estate agents, and property managers in Australia. The App provides:

• Digital property inspection forms and checklists
• Photo capture and annotation tools
• Report generation and export capabilities
• Local data storage and management
• Offline functionality for field inspections

3. License and Permitted Use

3.1 License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on your iOS device for your personal or business property inspection activities.

3.2 Permitted Uses

• Conducting property inspections for legitimate business purposes
• Creating and managing inspection reports and documentation
• Storing inspection data locally on your device
• Exporting and sharing inspection reports with authorized parties

3.3 Prohibited Uses

You may not:

• Reverse engineer, decompile, or disassemble the App
• Use the App for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to the App or its systems
• Remove or modify any proprietary notices or labels
• Use the App to create competing products or services
• Share your license with unauthorized third parties

4. User Responsibilities

4.1 Professional Standards

You are responsible for ensuring that your use of EzyInsp complies with all applicable professional standards, industry regulations, and local laws in Australia, including but not limited to:

• Real Estate and Property Agents Act 2002 (Qld)
• Property Occupations Act 2014 (Qld)
• Australian Consumer Law
• Privacy Act 1988 (Cth)

4.2 Data Accuracy

You are solely responsible for the accuracy, completeness, and reliability of all inspection data, reports, and information created using the App.

4.3 Device Security

You are responsible for maintaining the security of your device and protecting access to the App and your inspection data.

5. Data Ownership and Privacy

5.1 Your Data

You retain full ownership of all inspection data, reports, photos, and other content created using the App. We do not claim any ownership rights to your data.

5.2 Local Storage

All your inspection data is stored locally on your device. We do not access, store, or transmit your inspection data to our servers or any third parties.

5.3 Privacy

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the App, to understand our practices.

6. Disclaimers and Limitations

6.1 "As Is" Basis

The App is provided on an "as is" and "as available" basis. We make no representations or warranties of any kind, express or implied, regarding the App's operation or functionality.

6.2 Professional Responsibility

You acknowledge that:

• The App is a tool and does not provide professional advice
• You remain solely responsible for your professional judgments and decisions
• You must comply with all applicable professional standards and regulations
• The App does not guarantee compliance with any specific standards or requirements

7. Limitation of Liability

To the maximum extent permitted by law, EzyInsp and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, data, or business opportunities
• Professional liability or regulatory issues
• Errors or omissions in inspection reports
• Device malfunction or data loss

Our total liability shall not exceed the amount paid by you for the App, if any.

8. Indemnification

You agree to indemnify, defend, and hold harmless EzyInsp and its developers from and against any claims, damages, losses, costs, and expenses (including reasonable attorney fees) arising from your use of the App, violation of these Terms, or infringement of any third-party rights.

9. Updates and Modifications

9.1 App Updates

We may release updates, patches, or new versions of the App. While not required, we recommend keeping the App updated for optimal performance and security.

9.2 Terms Updates

We reserve the right to modify these Terms at any time. We will notify users of significant changes through the App or other reasonable means. Continued use of the App after changes constitutes acceptance of the new Terms.

10. Termination

You may terminate this agreement at any time by uninstalling the App from your device. We may terminate or suspend your access to the App immediately, without prior notice, if you breach these Terms.

Upon termination, your right to use the App ceases immediately, but your data ownership rights remain intact.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of Australia. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of Australia.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
